Intellectual Property in Rwanda

Rwanda has developed a comprehensive IP framework to encourage innovation and protect creators' rights, aligned with international standards.

Types of IP Protection

1. Patents

  • Protection period: 20 years
  • Requirements: novelty, inventive step, industrial application
  • Filing: RDB or ARIPO

    2. Trademarks

  • Protection period: 10 years (renewable)
  • Covers: logos, brand names, slogans
  • Filing: RDB

    3. Copyright

  • Automatic protection upon creation
  • Duration: Life + 50 years
  • Covers: literary, artistic, musical works

    4. Industrial Designs

  • Protection period: 5 years (renewable 2x)
  • Covers: aesthetic aspects of products

    Registration Process (Patents/Trademarks)

    1. File application with RDB

  • Formality examination
  • Publication for opposition
  • Substantive examination
  • Grant or rejection
  • Registration and certificate

    Enforcement

    IP rights holders can:

  • File civil suits for infringement
  • Request customs seizure of counterfeit goods
  • Pursue criminal prosecution (for serious violations)
  • Seek injunctions and damages
